Community Guidelines

These Community Guidelines ("Guidelines") govern all use of Daysync's Tour Chat and every other feature of the Daysync platform (the "Platform"). They are incorporated into the Terms of Use and must be read together with the Privacy Policy. In the event of conflict, the Terms of Use and Privacy Policy prevail. Daysync may amend these Guidelines at any time, and your continued use of the Platform constitutes acceptance of them.


1. Scope and application

These Guidelines apply to all conduct on the Platform and to all content, communications, files, images, video, audio, documents, links, and attachments uploaded, transmitted, or stored anywhere on the Platform ("Content"). They apply in public channels, private channels, and direct messages alike, and irrespective of whether the parties to a communication consent to the Content.


2. Prohibited content and conduct

The Content and conduct described in this Section are prohibited. Daysync will take enforcement action against any violation in accordance with Section 4.

2.1 General prohibitions

The following are prohibited on the Platform. This list is illustrative and not exhaustive:

  • Harassment, threats, and stalking — targeted personal attacks, threats of violence, intimidation, or persistent unwanted contact.

  • Terrorism and violent extremism — promoting, glorifying, facilitating, or inciting terrorism, violent extremism, or organised criminal activity.

  • Illegal goods and activities — offering, promoting, or facilitating the sale of controlled substances, weapons, stolen property, counterfeit goods, or any other unlawful goods or services.

  • Fraud and deception — obtaining money, credentials, or other value through deception, fraud, or misrepresentation.

  • Disclosure of personal information — publishing a third party's personal information, including home address, telephone number, identification details, or financial information, without that person's consent.

  • Impersonation — misrepresenting your identity, role, or affiliation, or impersonating any other person or entity.

  • Malware and phishing — transmitting files, attachments, or links containing viruses, malware, or phishing mechanisms.

  • Spam — bulk messaging, unsolicited marketing, or repeated promotional content unrelated to the relevant tour.

2.2 Sexual material

The sharing of sexual material is absolutely prohibited. This prohibition is total and admits no exception. It applies to all sexually explicit images, video, audio, text, links, and other sexual Content, in any context, irrespective of the consent of any person involved. For the avoidance of doubt, this prohibition extends to the distribution of intimate images of any person without that person's consent, which may also constitute a criminal offence.

Daysync moderates sexual material by automated means. Such Content may be blocked, removed, withheld, or escalated to Daysync automatically and without prior human review. Any dispute of a moderation decision under this Section must be submitted by email to [email protected]; no other method of dispute will be accepted. Daysync will review each request and notify the User of its determination.

2.3 Hateful content

Hateful content is prohibited and is flagged and moderated by Daysync. It includes, without limitation, any Content that attacks, dehumanises, demeans, threatens, harasses, or incites hatred or violence against any person or group on the basis of:

  • Race, colour, ethnicity, or national origin;

  • Religion or religious belief;

  • Sex, gender, or gender identity;

  • Sexual orientation;

  • Disability or serious medical condition;

  • Age;

  • Immigration, refugee, or citizenship status;

  • Caste; or

  • Any other characteristic protected under applicable law.

Hateful content further includes slurs, hateful symbols and imagery, dehumanising comparisons, and Content that promotes, celebrates, or endorses hateful ideologies or hate groups. Where Daysync is notified that hateful content has been shared on the Platform, Daysync is obligated to report such Content and will report it to the relevant authorities where required by applicable law.

2.4 Child safety

Child sexual abuse material ("CSAM"), any Content that sexualises a minor, and any Content that endangers a minor are absolutely prohibited. Daysync is legally obligated to report such material to the relevant authorities, including the National Center for Missing & Exploited Children (NCMEC) and the Australian eSafety Commissioner.


3. Reporting violations

Content that violates these Guidelines may be reported using the report function adjacent to the relevant message. Reports are transmitted to (a) Daysync's moderation team and (b) the organisation administrators of the tour in which the Content was shared.

Reports are not anonymous as against the organisation administrators of the relevant tour. The identity of the reporting User, the reported Content, any attachments, and surrounding context will be disclosed to both Daysync and those administrators. Daysync prioritises matters that are serious or involve unlawful Content and will act on urgent matters as promptly as is reasonably practicable, but warrants no specific response time.


4. Enforcement

Where Daysync determines that Content or conduct violates these Guidelines, the Terms of Use, or applicable law, Daysync may, at its sole discretion, take any one or more of the following actions:

  • Remove or restrict access to the Content;

  • Issue a warning to the responsible User;

  • Suspend the User's access to Tour Chat or other features of the Platform;

  • Suspend or terminate the User's account;

  • Preserve the Content and associated records for evidentiary purposes; and

  • Report the matter to law enforcement or any other competent authority where required or permitted by law.


5. Notice and appeals

Except where prohibited by law, Daysync will notify an affected User by email of any removal, restriction, suspension, or termination, stating (a) the action taken, (b) the Guideline or legal basis relied upon, (c) the facts relied upon, and (d) the procedure for appeal.

A User may appeal an enforcement decision within thirty (30) days of the date of notice, by replying to the notification email or emailing [email protected]. Daysync will review the appeal and notify the User of its determination. Daysync's determination of an appeal is final, save where applicable law confers further rights upon the User.


6. Repeat violations

Daysync may suspend or permanently terminate the account of any User who repeatedly violates these Guidelines. Daysync will ordinarily provide prior warning, but may act immediately and without prior warning in cases involving unlawful Content or serious harm.


7. Retention of reported Content

A User may delete that User's own messages within Tour Chat at any time. Where Content has been reported, however, Daysync will retain a copy of that Content, together with the surrounding context, separately from the live chat history, in order to investigate reports, substantiate and defend its determinations, and comply with applicable legal obligations to preserve evidence. Further detail is set out in the Privacy Policy.


8. Organisation administrators

Each tour on the Platform is managed by one or more organisation administrators, who may create public and private channels, add and remove members, delete messages within channels they manage, and receive notifications of reports concerning Content within their tour. Organisation administrators may not access a User's direct messages or private channels of which they are not a member.

Daysync is not responsible for the internal management of any organisation. A User may raise concerns regarding the conduct of an organisation administrator with Daysync, and Daysync will review such concerns; however, the day-to-day administration of a tour remains the responsibility of the organisation operating that tour.


9. Safety and emergencies

Daysync is not an emergency service. A User in immediate danger or in need of urgent assistance must contact local emergency services. Where Content involves a credible threat of harm to any person, the User must report such Content through the Platform and contact local authorities directly.
